Background facts: The Competition Commission of Pakistan (hereinafter the “Commission”), upon reference and concern expressed by the Consumer Association of Pakistan took notice of the marketing practice in the paint industry of inserting redeemable coupons and issued SCN for prima facie violation of Section 10 of the Competition Act 2010 (the “Act”) for engaging in deceptive marketing practices. Order: Based on the submissions, the Commission concluded that the non-disclosure of tokens in paint packs, is deceptive and in violation of section 10 of the Act. The undertakings were given certain directions and were directed to file a compliance report no later than March 30, 2012. Continued violation and/or non-adherence to the directions of the Commission, by any of the Undertakings shall entail penal consequences.
