Exemptions

Any agreement that restricts competition may be granted an exemption by the Commission if it meets the criteria given in §9 of the Act.


To qualify for an exemption, the parties must prove that the agreement (i) substantially contributes to improving production or distribution, (ii) promotes technological or economic progress, while allowing consumers a fair share of the resulting benefit; or (iii) clearly outweighs the adverse effect or lessening of competition.

An exemption may be granted with or without conditions. the Commission may withdraw the exemption if the parties do not comply with the conditions imposed in the exemption agreement.
