Background Facts:

Competition Commission of Pakistan took notice of the terms and conditions that amounted to abuse of a dominant position by Indus Motors by imposing unfair trading conditions on its customers by way of its provisional booking order (PBO) in violation of Section 3(3) (a) of the Act and issued SCN dated 13th March 2013 to M/S Indus Motor Company Limited (“Indus Motors”).

Following the issuance of the show cause, the undertaking requested for the opportunity to revise the draft of the PBO and rectify the Commission’s concerns and a revised draft was submitted. Various clauses of the revised PBO relating to were analyzed.

Order:

The Commission vide this order disposed of the proceedings initiated under Section 30 of the Competition Act, 2010, subject to incorporation of revised terms and conditions as approved by the concerned Bench.
